If you're at least 18 years old and mentally competent, you can marry without parental consent.

Aged 16 and 17?

If you're 16 or 17 years old, you can marry with the consent of a custodial parent or guardian. Consent can be granted in person or by sworn affidavit.

Aged 15 and under?

If you're below the age of 15, you can't marry, except in cases of pregnancy.

Update: On December 12, 2018, State Senator Katrina Shealy (R) introduced Senate Bill S0196, which would outlaw marriage below the age of 16.

Is there a pregnancy exception?

Update 1: On December 18, 2018, South Carolina House Representatives Beth Bernstein, Neal Collins, and Shannon Erickson pre-filed House Bill 3369, which would rescind the pregnancy exception provision that allows minors to marry.

Update 2: As of November 30, 2022, state law no longer allows females below the age of 18 to marry without parental consent if she's pregnant or have given birth to a child.

Premarital Education

What's the benefit of taking a premarital preparation course?

Complete a 6-hour premarital preparation course within a year before marriage to get a one-time $50 state income tax credit. The course must be taken together. The tax credit will be split 50/50. Show your certificate of completion when applying to have your license properly notated.

Waiting Period

When will I get my license?

Your marriage license will be ready for pick up 24 hours after filing your application. Remember, most probate courts are closed weekends.

Can the waiting period be waived?

The mandatory 24-hour wait can't be waived, nor will a license be issued in advance showing tomorrow's "effective" date.

Expiration

How long will my marriage license last?

South Carolina marriage licenses do not expire, which is a rarity among states.

Identification

What ID should I bring?

ID for adults?

If you're at least 18 years old, bring valid government-issued photo ID that verifies your age.

ID for minors?

In addition to showing photo ID, minors must surrender an original or certified copy of their birth, baptismal, or hospital certificate.

ID for parental consent?

The consenting parent must bring ID. If divorced, bring a certified copy of the divorce decree proving custody. Guardians, bring ID and proof of guardianship.

Some probate courts will ask to see your social security card or another document containing your social security number.

Do I have to get a blood test?

You don't have to get a premarital blood test. However, you'll be given information on family planning.

Divorced

What if I'm divorced?

Some probate courts will ask to see a certified copy of your divorce decree, especially if divorced within the past year.

Widowed

What if I'm a widow or widower?

Widows and widowers don't need to bring their late spouse's death certificate.

Name Change

How do I change my name because of marriage?

Changing your name after marriage in South Carolina isn't automatic. The name change process utilizes your marriage certificate to authorize various federal and state organizations to honor your request. They must be alerted individually, starting with the Social Security Administration.

Do I need to bring witnesses?

Witnesses aren't required to attend your marriage ceremony.

You can be married by a minister of the gospel, rabbi, notary public, official authorized to administer oaths, or leader of a state-recognized Indian entity.

You and your prospective spouse can't act as your own officiant. A third-party must be involved.

Some probate courts provide civil ceremony services by appointment for roughly $20.

Your marriage license must be returned to the issuing probate court for recording and indexing within 15 days after the ceremony.

How do I get a copy of my marriage certificate?

Probate courts sell certified marriage certificate copies for about $5, but only for marriage licenses their office issued. The state's vital records office also sells them for $12, but only spanning July 1950 to December 2014.

Proxy Marriage

Can I get married by proxy?

You can't get married by proxy by using a stand-in to represent you. Physical attendance of your ceremony is mandatory.

Prohibited Marriage

Can I marry if I'm not divorced?

Marriage without first divorcing is allowed if your spouse has abandoned you for the past five years and their whereabouts is unknown.

Can I marry my cousin?

You can indeed marry your first cousin.

Is marriage among certain family members permitted?

You can't marry a descendant, ascendant, sibling, stepsibling, aunt, uncle, niece, or nephew. Cousins are ok though.

Common-law Marriage

Can I obtain a common-law marriage?

The South Carolina Supreme Court abolished common law marriage in South Carolina effective July 24, 2019. However, common law marriages established before this date will remain valid.

      Although all probate courts are permitted to perform marriages, not all do. And not all those that do publish their services. If there's a set of counties you're considering, reply back here and I'll try and look that up for you.

    1. Hi Michael. The 24-hour wait is standard across the state. At best you could request the license be issued immediately, with its effective date stamped for Saturday. You may want to call ahead to determine if this would even be possible.

    1. Hi Rebecca. There are no special requirements for out-of-state residents. Bring ID and your social security card. If you can't bring the latter, bring a document that shows your SSN.

      Your partner should bring a certified copy of their divorce decree. Widowers typically don't have to show their late spouse's death certificate, but if you already have it, it doesn't hurt to bring as well.

      Finally, make sure you factor in the 24-hour waiting period before receiving your license.

  31. I am a notary in SC. I have officiated a wedding before and did the ceremony and such. This time, I have been asked to witness a wedding and they wanted a minister from out of the country to actually perform the ceremony with me being there.

      If you were to get married, this would erase all doubt. You should consider consulting with a South Carolina lawyer versed in common-law marriages and how it would affect future benefits if you don't formally marry.

    1. Hi Meri. If the probate court made the error, they should reissue you a new marriage license for free. Otherwise, you might have to pay a reissue fee.

  67. What if my social is in Virginia with my parents in a safety deposit box? We are getting married June 24. 2023, but I have a picture of it.

    1. Hi Shana. Not all probate courts will ask to see your social security card. If you can't produce one, you can inquire if a document that shows your social would be acceptable.

  68. If I obtain a license in one county but move to another county before the ceremony, which county do I turn the license back in? Can you turn it in another county?

    1. Hi Renee. You must return your marriage license to the same probate court that issued it.

  69. Can two foreign nationals of different faith get married in South Carolina? What all do we need to provide? Is there a listing available to find an official that will marry us there?

    1. HI Naomi. Faith is not a factor when applying for a marriage license. The probate court you apply at may be able to perform your marriage. If not, you'll have to hire a third-party officiant.

  70. What if we live in Maryland but are getting married in South Carolina? We won't be in town long enough to get a marriage license in person?

    1. Hi Jerrica. You'll have to somehow carve out the time to apply for your marriage license in person, as you can't apply by absentee ballot or by proxy. You can apply in any SC county and marry in any SC county, so you could limit your drive time by applying in a county on the edge of the state's border.
